The installation of "Instant Racing" machines has been a bonanza for long-time racing executive Corey Johnson and his Kentucky Downs.
But, use of the machines that offer wagering on pre-run horse races, continues to be challenged by the Family Foundation of Kentucky, a group that has appealed the machines’ approval to the state Court of Appeals.
A hearing was held last week and the court has promised a decision within four to six weeks.
The machines were originally approved by the Kentucky Horse Racing Commission in 2010.
