Unsuccessful in state courts, Japanese billionaire Kazuo Okada has taken his fight to retain his seat on the Wynn Resorts Ltd. board of directors to the U.S. District Court.

In the most recent suit, Okada charges CEO Steve Wynn, who is pushing for his former partner’s ouster, has used “false and misleading statements” to influence shareholders who will vote on the matter at a special meeting on Feb. 22.

Okada also has charged Wynn used questionable means to obtain real estate for his Macau development on the Cotai Strip.
