The Massachusetts Gaming Commission voted to hold an adjudicatory hearing over FanDuel’s handling of Bill Simmons’ proxy-betting case, according to InGame.

Enforcement action could target FanDuel, Simmons or the person who placed the wagers on his behalf.

A hearing date has not been set.

Simmons Case Involves $21,800 in Wagers

Zachary Mercer of the commission’s Investigations Enforcement Bureau said Simmons placed 22 wagers through a proxy. The wagers totaled $21,800 across three days between Aug. 7 and Aug. 19, 2026.

Simmons described the arrangement on his Aug. 30 podcast. He said his daughter’s boyfriend, Hank, placed bets for him while Simmons was in California. Simmons wanted futures wagers on UCLA and the Houston Texans.

Hank was 21, the minimum legal betting age in Massachusetts. Proxy betting violates both commission and FanDuel rules.

FanDuel self-reported the violation to the commission the day after the podcast. It also voided the wagers and took action on the account.

Commissioner Paul Brodeur asked whether enforcement could extend to FanDuel, Simmons or Hank. Mercer said nothing precluded action against any of them. Commissioner Eileen O’Brien said the case offered an opportunity to examine proxy betting more deeply.

BetMGM and Fanatics Face Further Investigation

The commission also requested further investigation into separate compliance cases involving BetMGM and Fanatics Sportsbook.

BetMGM’s case involved more than 300 wagers with location or device-related compliance issues. These included 109 wagers totaling $4,936.59 from 56 accounts outside Massachusetts, in areas where BetMGM was not licensed.

Another 190 wagers totaled $15,564.42. Those came from 25 Massachusetts accounts that should have been blocked for device-modification or software reasons.

Fanatics failed to notify 132 patrons it had decided to limit between July 29 and Sept. 7.

Separate Fines Approved as Renewals Approach

The commission approved three fines recommended by its enforcement bureau:

  • Caesars Sportsbook: $7,500 for accepting wagers on a non-approved boxing match.
  • MGM-Springfield: $7,500 for accepting wagers on the Heisman Trophy.
  • Caesars Sportsbook: $10,000 for accepting wagers on a Northeastern University baseball game.

Commissioners also approved house-rule changes for BetMGM, Caesars Sportsbook, DraftKings and FanDuel.

Staff said operator renewal documents were being prepared. The first renewal round since Massachusetts online sports betting launched in March 2023 is set for February.
