The fight in Indiana over sweepstakes casinos intensified Feb. 18 as the Indiana Senate voted 37-8 to pass House Bill 1052, bringing the controversial measure one step closer to law.
If enacted, the bill would prohibit gaming platforms utilizing a sweepstakes model from operating within the state. Because the Senate amended the bill, it now returns to the Indiana House of Representatives for concurrence.
Prohibiting dual-currency gaming models
The primary objective of HB 1052 is to halt online games, contests, and promotions that use a dual-currency system. In these models, players typically purchase one type of virtual currency and receive a second type as a “bonus” that can be redeemed for cash or prizes.
Proponents of the bill argue this structure is functionally equivalent to gambling, regardless of whether operators label it social or promotional gaming.
Under the proposed framework, such offerings would be banned in Indiana. The bill also carries heavy penalties: Regulators could fine operators who offer sweepstakes-style games within state lines up to $100,000 per violation. The severity of the fine suggests Indiana lawmakers aim to eliminate the model rather than merely discourage it.
Tight deadline for final House approval
Rep. Ethan Manning introduced HB 1052 in December 2025. The House passed the bill Feb. 4 before sending it to the Senate. The amended version must now receive final House approval before heading to the desk of Gov. Mike Braun.
Timing is critical. The Indiana legislative session is scheduled to adjourn Feb. 27. If signed, the law would take effect July 1, 2026.
SGLA advocacy for regulation vs. prohibition
The approach has met significant resistance. Following the House vote earlier this month, the Social Gaming Leadership Alliance (SGLA) called for regulation over outright prohibition.
According to a news report by Global Gaming Insider, Sean Ostrow, the organization’s managing director, argued that “social plus” games have operated lawfully in Indiana since 2012 and are used by hundreds of thousands of residents. Ostrow characterized the bill as an overly broad attempt to target bad actors that inadvertently harm legitimate businesses.
In testimony submitted Jan. 6, the SGLA suggested that banning compliant businesses would not necessarily eliminate illegal operators. The group maintains that a regulated framework would offer stronger consumer protections while keeping reputable companies in the market.
A national shift in sweepstakes legality
Indiana’s move reflects a broader national debate. Several states are currently examining whether sweepstakes-style games comply with existing gambling statutes or exploit legal gray areas.
Advocates for the ban argue that dual-currency systems blur the line between social gaming and real-money wagering. Conversely, critics contend many platforms have operated transparently for years without issue.
Indiana lawmakers appear poised to draw a definitive line. The final House vote and the governor’s signature will determine if that line holds. For now, Indiana’s sweepstakes operators are on high alert; by July 1, the state’s gaming landscape could look fundamentally different.
