New Jersey says it is the first state to make data-driven responsible gaming measures mandatory.
Operators must review patrons flagged by play thresholds and behavioral triggers, then provide phased interventions when they identify signs of potential problem gambling.
Atty. Gen. Jennifer Davenport and the Division of Gaming Enforcement announced the requirements on Wednesday, saying they have been codified into state regulations with the force of law. The announcement also introduced free access to RecoverMe, an app intended to help people in New Jersey manage gambling problems.
Operators Must Review Warning Signs and Intervene
The requirements establish a mandatory process for identifying and responding to potential gambling harm. Operators must:
- Appoint a responsible gaming lead.
- Use mandatory patron play thresholds and behavioral triggers to identify people who may need support.
- Conduct a due diligence review when patrons meet those criteria.
- Add patrons showing signs of potential problem gambling to an at-risk list and apply three phases of intervention based on the operator’s assessment.
The state said there was previously no uniform, regulatorily enforceable standard governing when further review and phased intervention were required.
“Our regulations identify and respond to gambling-related harm. When signs of problem gaming arise, operators must act to ensure early intervention and support, tiered to individual need,” DGE Interim Director Mary Jo Flaherty said.
For patrons, the process links identified warning signs to a required review and, where warranted, support. The supplied announcement does not detail the specific thresholds or what each intervention phase entails.
“We are proud to enact regulations that require operators to offer resources, including live support if appropriate, to those struggling with problem gambling,” Davenport said.
RecoverMe Adds a Free Support Option
RecoverMe uses cognitive behavioral therapy to help users manage gambling problems. Through an agreement with the app’s operator, it is available free to anyone located within New Jersey, according to the state.
The app can be downloaded from the Apple App Store or Google Play Store. The state lists NJ100 as the code for free access.
RecoverMe is the second free service offered by DGE for people experiencing gambling problems. Last year, the division began providing access to GamFin, a financial counseling service.
State Also Seeks Supreme Court Review in Kalshi Case
Separately, New Jersey said it is asking the U.S. Supreme Court to hear its case against prediction market Kalshi, arguing that prediction markets must be subject to state gaming laws.
A bipartisan coalition of 39 states and the District of Columbia, 146 Indian tribes and tribal organizations, the NFL, and leading industry organizations filed amicus briefs supporting the state’s request. The announcement does not establish whether the court will take the case.
