If you want a snapshot of the complexities of gambling policy, look no further than the Indiana Statehouse this week. Lawmakers are weighing two divergent paths for online gaming as the legislative session nears its end.
One proposal would ban online sweepstakes casinos. The other would allow the Hoosier Lottery to sell tickets via mobile devices. Same building, same week, entirely different directions. With adjournment set for Friday, the pressure is on.
The final countdown for sweepstakes casinos
The conference committee has officially released House Bill 1052, which includes language making online sweepstakes casinos illegal. Lawmakers said the latest changes were minor technical fixes that do not affect the underlying ban.
The bill has already cleared both chambers once. Earlier this month, the House voted 86-12 in favor. The Senate followed with a 37-8 vote but added an unrelated amendment, necessitating the conference committee for final reconciliation. Rep. Ethan Manning, the bill’s sponsor and conference committee chair, noted his disagreement with removing language previously used in separate legislation.
If both chambers approve the report, the ban would take effect July 1.
Regulation floated, then faded
Total prohibition wasn’t the only option on the table. According to a news post by Legal Sports Report, Sen. Ron Alting said he proposed an amendment to regulate and tax sweepstakes operators rather than ban them.
However, he noted that leadership in both chambers made it clear the proposal lacked the necessary support. Sen. David Niezgodski also signaled he was open to a regulatory framework.
Industry representatives have consistently argued that regulation is the superior approach. Their warning is blunt: Players will not stop playing if legal operators leave the state. Instead, many may migrate to offshore sites that lack oversight and consumer protections. Ultimately, however, the momentum for a ban surpassed the appetite for regulation.
A digital future for the Hoosier Lottery
While sweepstakes platforms face a phaseout, the Hoosier Lottery is looking to expand. House Bill 1078 would permit online sales for draw and “eInstant” games. The House Public Policy Committee voted 9-3 to send the bill to the full House.
Even with immediate approval, online lottery sales would not begin overnight; officials cited summer 2027 as a realistic timeline. This window would allow the lottery to select vendors and implement age-verification and geolocation systems to ensure players are at least 18 and physically located within Indiana.
Proponents framed the move as simple “modernization,” noting that consumers already use smartphones for banking, shopping, and investing.
Economic gains and social risks
An analysis by the Legislative Services Agency estimates that online lottery sales could significantly increase revenue by the third year, boosting annual profits by tens of millions of dollars. With lottery sales plateauing at roughly $1.7 billion annually over the last five years, proponents see a clear financial upside.
However, critics—specifically mental health advocates—warn that increased accessibility carries inherent risks. Online gambling removes the physical barriers of retail locations, and advocates worry that constant availability and targeted marketing could exacerbate addiction, particularly among young adults.
